Acceptance of terms
If you use BitGuardIT on behalf of an organization, you represent that you have authority to bind that organization. If you do not agree to these Terms, do not use the services.
Account requirements
- Provide accurate registration information and keep it current.
- Maintain the confidentiality of credentials and notify us of suspected unauthorized access.
- Ensure users under your account comply with these Terms.
- Complete email verification when required to activate full platform features.
Organization accounts
Client accounts are associated with an organization. Organization administrators and BitGuardIT platform administrators may manage users, subscriptions, and entitlements according to platform capabilities. You are responsible for all activity under your organization account.
Proof of ownership verification
BitGuardIT requires asset ownership verification and active authorization before scanning. Verification methods may include DNS TXT records, development-mode confirmation where enabled, or other mechanisms presented in the portal. Bypassing or falsifying verification is prohibited.
Acceptable use rules
Use BitGuardIT solely for lawful defensive security assessment, monitoring, and related professional services. See the Acceptable Use Policy for additional detail.
Prohibited activities
- Scanning or testing systems without authorization.
- Attempting to disrupt BitGuardIT or third-party infrastructure (denial of service, malware distribution, etc.).
- Accessing other customers' data or portal areas without permission.
- Reverse engineering or circumventing security controls except as permitted by law.
- Misrepresenting identity, ownership, or authorization.
- Using the platform to harass, defame, or violate applicable laws.
Customer responsibilities
- Evaluate and implement remediation for findings and recommendations.
- Maintain backups and business continuity independent of BitGuardIT.
- Ensure submitted assets and data do not infringe third-party rights.
- Configure appropriate internal access controls for your organization users.
Service descriptions
Services available to your organization depend on active subscriptions, trials, orders, and entitlements displayed in the portal. Service catalog entries describe automated, human-assisted, and hybrid offerings.
Automated security scanning
Automated scans identify potential vulnerabilities and misconfigurations using configured scanners and enrichment sources. Results are probabilistic and may include false positives or miss issues. Scans are non-destructive by design but you should ensure testing is authorized for production systems.
Human security review services
Expert services are delivered by qualified personnel subject to scope agreements. Deliverables and timelines vary by service type and may require your cooperation for access and validation.
Reports and recommendations
Reports summarize platform data at a point in time. Recommendations and AI-generated content are advisory and do not constitute legal, regulatory, or professional certification of compliance. You remain responsible for decisions based on report content.
Subscription and billing
- Fees are charged according to selected plans, service catalog prices, and currency shown at purchase.
- Recurring subscriptions renew according to plan terms until cancelled.
- One-time services are billed at order placement.
- Taxes may apply based on jurisdiction.
- Failure to pay may result in suspension of entitled features.
Trial periods
Eligible organizations may access trial entitlements for a limited period as shown in the portal. Trials may provide broad feature access for evaluation. At trial end, continued use requires an active paid subscription or order unless otherwise stated. BitGuardIT may modify or discontinue trial programs.
Service availability
We strive for reliable operation but do not guarantee uninterrupted access. Maintenance, third-party outages, and force majeure events may affect availability. Scheduled maintenance will be communicated when practicable.
Suspension and termination
We may suspend or terminate access for violation of these Terms, non-payment, abuse, or legal requirement. You may stop using the services at any time; cancellation procedures are available through Billing and support. Provisions that by nature should survive termination (confidentiality, liability limits, dispute terms) remain in effect.
Intellectual property
BitGuardIT retains all rights in the platform, software, branding, documentation, and underlying technology. No rights are granted except as expressly stated. You may not copy, modify, or create derivative works of the platform except as permitted by law.
Customer data ownership
You retain ownership of Customer content. You grant BitGuardIT a worldwide, non-exclusive license to host, process, and display Customer content to provide the services.
Confidentiality
Each party will protect the other's confidential information with reasonable care and use it only for purposes of the relationship. Security findings and reports are treated as your confidential information subject to the Privacy Policy.
Limitation of liability
To the maximum extent permitted by law, BitGuardIT's aggregate liability arising from the services shall not exceed the fees paid by your organization to BitGuardIT in the twelve months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or business opportunity.
Warranty disclaimer
The services are provided "as is" and "as available." BitGuardIT disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the services will detect every vulnerability or prevent security incidents.
Indemnification
You will indemnify and hold harmless BitGuardIT from claims arising from your unauthorized scanning, violation of these Terms, infringement by Customer content, or misuse of the platform, except to the extent caused by BitGuardIT's gross negligence or willful misconduct.
Updates to terms
We may update these Terms from time to time. Material changes will be indicated by updating the "Last updated" date and, where appropriate, notification through the portal or email. Continued use after changes become effective constitutes acceptance.
